2. Products

We sell sunglasses and related accessories. We make every effort to display our products, colours, and materials as accurately as possible, but slight variations (e.g. due to screen display) may occur. All products are unisex unless stated otherwise.

3. Orders and Contract Formation

• Placing an order on our Site constitutes an offer to purchase. We will send you an order confirmation email once your order is received.
• A binding contract of sale is formed once we confirm and accept your order (i.e. upon shipment confirmation or order confirmation email, whichever we specify).
• We reserve the right to refuse or cancel an order, for example in cases of suspected fraud, pricing errors, or stock unavailability. If we cancel an order after payment, you will receive a full refund.

4. Prices and Payment

• All prices are displayed in euros (EUR) and include applicable VAT unless stated otherwise.
• We accept payment via the methods offered at checkout, processed securely through our payment providers.
• We reserve the right to change prices at any time; the price applicable to your order is the price displayed at the time of purchase.

5. Shipping

Waylon Smith covers all shipping costs on orders within the areas we serve, unless otherwise indicated at checkout.

Risk of loss and title for products pass to you upon delivery.

6. Right of Withdrawal (30-Day Return Policy)

As a consumer in the EU, you have a statutory right to withdraw from your purchase within 14 days without giving any reason. Waylon Smith extends this right to 30 days from the date you receive your order.

7. Warranty / Legal Conformity Guarantee

All products come with a 2-year statutory conformity guarantee, in accordance with EU consumer protection law. This means that if a product is defective or does not conform to the contract, you are entitled to a repair, replacement, price reduction, or refund, depending on the circumstances. This guarantee does not cover damage resulting from normal wear and tear, misuse, or accidents.

8. Intellectual Property

All content on this Site — including the Waylon Smith name, logo, product designs, images, and text — is the property of Waylon Smith VOF or its licensors and is protected by intellectual property law. You may not reproduce, distribute, or use this content without our prior written consent.

9. Limitation of Liability

To the extent permitted by law, Waylon Smith VOF is not liable for indirect, incidental, or consequential damages arising from the use of our products or Site. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, including liability for death, personal injury, or fraud.

10. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. If you are a consumer residing in another EU member state, you also benefit from any mandatory consumer protection provisions of your country of residence. Disputes may be submitted to the competent Dutch court, or, where applicable, resolved via the EU's [Online Dispute Resolution platform](https://ec.europa.eu/consumers/odr).
